Well that patent expired already quite some time ago, and that was way before the rapid popularity increase of the powerball, which in fact only occured after Nanosecond launched their high quality product (the NSD powerball). Please note that originally the powerball was invented as an exerciser in weightless spaces (like in Space :P). Quite a bit later (10-15 years ago) the powerball was introduced in the consumer market. But probably the quality was sh.t so nobody go excited about it. Moreover, I think it was Nanosecond who came with the counter which really gave the popularity a boost. In the end, everybody wants to know how good he is, right?
